ACA Compliance Notice: With the end of 2015 closing in fast, it is critical to prepare for the Affordable Care Act (ACA/Obamacare) reporting requirements due at the beginning of 2016. Many employers are still confused about the requirements, many even being subject to ACA, but not providing the required health coverage...thus facing very expensive penalties and fines.
Who is subject to the ACA: The following are subject to the ACA requirements and reporting:
  1. Companies with 50+ full-time employees, including FTEs.
  2. Companies who are part of another company and combined have 50+ full-time employees, including FTEs.
  3. Companies that have a shared ownership interest and combined have 50+ full-time employees, including FTEs
  4. Self-Insured companies are subject to the 1094-C and 1095-C reporting.

Important notes: It is important to understand a few key elements about ACA compliance.
  1. A 'full-time employee' is one who averages 30+ hours of work per week.
  2. Full-Time Equivalent (FTE) is calculated using the hours worked and paid (including paid time off hours) by non-full-time employees. 
  3. Non-working paid time off hours, such as vacation, PTO, personal days, and floating holidays are subject to the hours.
  4. Companies with a shared owner(s) or that have interests in other companies are generally required to combine all groups to determine if subject to ACA...even if each company has less than 50 full-time employees/FTEs.
