Penalties for Failing to Comply with Pregnancy Disability Leave Laws
An employee who is discriminated against because of her pregnancy may be entitled to any or all of the following remedies:
- Hiring
- Reinstatement
- Promotion
- Admission or re-admission to a labor organization
- Damages for lost wages and benefits
- Emotional distress damages
- In addition, the Department of Fair Employment and Housing (DFEH) may file a complaint on behalf of any person discriminated against.
